In a decision released today a District Court Judge has upheld a Queenstown Lakes District Council injunction around the occupation of a Wanaka property the council deems dangerous, QLDC corporate and regulatory services general manager Roger Taylor said.

An injunction was granted in August over the tenanted Tenby Street property, which resulted in the occupants shifting out.

"The owner of the property sought to have the injunction rescinded," Mr Taylor said.

In his nine-page decision, Judge R E Neave found that no evidence was produced to dispute the council's position that the building was dangerous.

"I am therefore of the view that the injunction was properly granted and that there are no grounds for rescinding it," Judge Neave found.

The decision meant the building would continue to be unoccupied, Mr Taylor said.

"That will remain the case until such time that the council is satisfied that the building no longer poses any danger to future occupants," Mr Taylor said.
