Infinity Appeal

The Queenstown Lakes District Council has chosen not to appeal the Infinity decision to the High Court; however as respondent to the Infinity appeal, it will act to assist the Court.
"Infinity has appealed the decision on several alleged errors of law. In particular Infinity has stated that the Environment Court failed to have regard for provisions of Wanaka 2020 and the resulting structure plan. That is a matter that the Council will be able to make submissions on, as respondent," QLDC chief executive Duncan Field said.
The full Council considered its options on Friday before deciding against taking an appeal.
"The Council has instead chosen to abide by the decision of the High Court and assist the Court by making submissions on any relevant matters of importance to the Council," Mr Field said.
The Council considered Infinity's appeal allowed it an opportunity to seek direction from the Court, as to the weight accorded to community consultation and community plans.
"The Council would prefer to put its resources into a plan change solution for this area of land, rather than defending this appeal," Mr Field said.
